OMB begins review of NSR proposal; final rule could depend on high court

The Bush administration has taken a key step towards issuing a third major New Source Review rule for electricity generators, as the Office of Management and Budget recently began reviewing an NSR measure that the Environmental Protection Agency proposed last year. The OMB review process is typically one of the last hurdles that executive branch agencies like EPA must clear before issuing new regulations. EPA sent its proposed NSR rule to OMB on August 18. "Final action" on the rule — meaning its promulgation date — is expected in January 2007, OMB said.
