Judge finds abstention opinion in Raritan Baykeeper does not warrant reconsideration of Interfaith decision

U.S. Chief Garrett E. Brown Jr. of the District of New Jersey held on July 9 that the recent abstention decision in Raritan Baykeeper, Inc. v. NL Indus., Inc., (D.N.J. No 09-4117) does not warrant reconsideration of a ruling which found that a consent judgment resolving all of the New Jersey Department of Environmental Protection's RCRA claims against PPG Industries Inc. does not moot the claims of Interfaith Community Organization and other groupsarising from chromium contamination of the Garfield Ave. site in Jersey City, New Jersey.
