Judge says EHB's rules do not provide for fees independent of Costs Act, which expired in 2007

An Environmental Hearing Board judge held on Feb. 2 that the board's rules do not provide for attorneys' fees independent of the Costs Act, which expired in July 2007, in a case decided in favor of an applicant for a landfill permit. Previously, the board found that the Department of Environmental Protection improperly denied the application of PA Waste LLC for a permit for a proposed landfill in Boggs Township, Clearfield County.
