States can pursuant to CERCLA - even in using their own money for removal- justify a six-year statute of limitations based on their determination of a "consistency waiver," the Department of Environmental Protection argued in a reply brief filed in its cost recovery lawsuit in connection with removal work at Bolden Landfill in Westmoreland County. The case is in federal court for the Western District of Pennsylvania.
