Cmwlth Ct orders EHB to quash N.J. company's attempt to deposit radioactive material in FA

Commonwealth Court ordered on Nov. 15 that appeal by a New Jersey company of two letters from the Pennsylvania Department of Environmental Protection concerning disposal of soil with radioactive material in Pennsylvania be quashed by the Environmental Hearing Board. (See issue of Oct. 15,2012 P. 7.) The letters stated that Sayreville Seaport Associates Acquisition Company LLC was precluded by statute and regulation from either disposing of soil with radioactive material or beneficially using it as regulated fill.
