The Environmental Hearing Board held on May 16 that the Department of Environmental Protection's decision not to take further action with respect to a complaint of well water contamination in the Marcellus Shale is appealable before the board. The DEP found that activities of Range Resources -Appalachia LLC, investigated under the Pennsylvania Oil and Gas Act, have not affected the water supply of Loren Kiskadden in Washington County.
