Judge finds Telford authority did not prove that EPA's failure to reconsider TMDL was 'final action'

U.S. Judge C. Darnell Jones Ⅱ of the Eastern District of Pennsylvania held on Nov. 15 that the Telford Borough Authority failed to prove that there was "final action" by the U.S. Environmental Agency on the authority's request to reconsider total maximum daily load (TMDL) for pollutant discharge to Indian Creek Waterway in Bucks County. "However," he said, "because the parties sharply dispute the matter, the court will grant the parties leave to engage in limited discovery on the matter of subject matter jurisdiction. Discovery on this matter shall be completed on or before Jan. 15, 2014."
