International Paper says Rexam is liable for 50 percent of cleanup undertaken before seeking reimbursement

International Paper Inc. contended on Dec. 18 that Rexam Inc. is not entitled to recovery on its counterclaim because, as Image Products Group's indemnitor, it is liable for 50 percent of the CERCLA liabilities for cleanup of the Crown Vantage Landfill based on a 1971 agreement. The case is in federal court for the District of New Jersey. (See issue of June 30, 2013 P. 10.) According to International Paper and Georgia-Pacific Inc., the unallocated liability provision in the 1971 agreement requires that Rexam and Image Products pay 50 percent of the landfill liabilities.
