Commonwealth Court held on Sept. 26 that Washington County Common Pleas Court erred in affirming the Cecil Township Zoning Hearing Board's denial of MarkWest Liberty Midstream & Resources LLC's special exception application to construct and operate a natural gas compressor station in the Marcellus Shale. "Most of the reasons for the denial, as heretofore indicated, are anticipated conditions that can be controlled through the use of the zoning ordinance itself by virtue of the conditions set forth for the issuance of special exceptions or by use of the inherent right in the municipality to restrain and eliminate any noxious use of land," the court said.
