In a reply brief, Hackensack Riverkeeper and other plaintiffs contended on Dec. 16 that New Jersey City University's plan to construct a buiding over part of a capped area of chromium contamination in Jersey City violates a consent decree with Honeywell Inc., the university and the plaintiffs. The case is in federal court for the District of New Jersey. (See issue of Nov. 30,2015 P. 11.) According to Riverkeeper, NJCU's plan for a parking garage violates the NJCU consent decree because it intends to build part of the building over the capped area and, in so doing, to penetrate a cap. Hackensack Riverkeeper seeks appointment of a special master to oversee implementation of future development.
