Trinity Industries and Chicago Bridge settlement ends claims over cleanup of railcar construction South site

Trinity Industries Inc. and Trinity Industries Railcar Corp. filed a settlement on Dec. 23 agreeing to dismiss claims with prejudice against Chicago Bridge and Iron Co. with respect to cleanup of the South Plant in Greenville. The case is in federal court for the Western District of Pennsylvania. (See issue of June 30,2015 Pages 6 and 13.) Trinity Industries' claims for common law indemnification and breach of contract were based on the indemnification agreement filed when Trinity sold the plant in 1985 to MBM Realty for $650,000. Trinity Industries purchased the South Plant from MBM in November 1988. In anticipation of the sale, MBM's counsel requested that CB&I consent to MBM's assignment of the indemnification agreement.
