Judge finds endangerment to environment 'in and of itself' under RCRA if contamination threatens ecosystem function

U.S. Judge Gene E. K. Pratter of the Eastern District of Pennsylvania held on Aug 24 that endangerment to the environment exists "in and of itself" under the Resource Conservation Restoration Act if contamination threatens "some potential function in the local ecosystem." (See issue of Aug. 15, 2015 Pages 6 and 15.) The judge denied Ursinus College's motion for summary judgment with respect to Tri-Realty Co.'s $7-million claim that heating oil from the college is endangering the College Arms Apartments with 350 people in a seven buildling complex in Collegeville, Montgomery County.
