Judge allows Seneca Resources' lawsuit against township with ordinance that prohibits wells for frack wastewater

U.S. Magistrate Judge Susan Paradise Baxter of the Western District of Pennsylvania held on March 29 that Seneca Resources Corp. has standing to challenge Highland Township's ordinance prohibiting the operation of underground injection control wells to dispose of waste from oil and gas extraction within the township. (See issue of Sept 30,2015 P. 6.) In August, the Pennsylvania Department of Environmental Protection suspended its review of Seneca's well permit application in part as a result of the conflict and potential for legal action against department pursuant to the ordinance.
