Chain marketer sues to block state's deadline to remove nozzle latch-open clips

Veteran West Coast marketer Tom Robinson has asked a court to block a state order requiring California retailers to remove latch-open clips from their dispenser nozzles by Oct. 15.rnState Fire Marshal Tonya L. Hoover has declared the clips on nozzles produced by Vapor Systems Tech-rnnologies, Inc. to be a public safety hazard. There have been seven incidents where they did not disengage when the nozzle was returned to the cradle, resulting in the next customer being sprayed with gasoline.rnRobinson says that if stations are forced to remove the clips before replacement nozzles are available, customers could be at more risk of injury because they will try to wedge open triggers to keep fuel flowing. Tennis balls and metal bolts have already been found in nozzles where clips have been removed.
