CQC takes on patient safety from HSE

The Care Quality Commission (CQC) is preparing to become the lead investigator and enforcer on incidents involving patients and service users in England, a role that is currently being carried out by HSE. The move follows the recommendations of the Francis report into the failings at the Mid Staffordshire NHS Foundation Trust, which identified a "regulatory gap" between the two bodies. The Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 will allow CQC to prosecute for some breaches of 'fundamental standards' from 1 April 2015, including scope to prosecute for failures to 'deliver care and treatment in a safe way'. HSE says it will "largely withdraw from these kinds of investigations save in exceptional circumstances".
