There is no duty to make reasonable adjustments for an employee who is associated with a disabled person, as opposed to a person who is actually disabled, the Court of Appeal (CoA) confirms in Hainsworth v Ministry of Defence (MoD). Hainsworth worked as a civilian for the Ministry of Defence at the Paderborn Garrison in Germany. She has a daughter, Charlotte, who has Down's syndrome and has special educational requirements. The MoD, through an executive agency, Service Children's Education, provides mainstream educational facilities for service and civilian personnel deployed overseas. But in Germany it does not provide special schools or support for children with more significant needs.
