The High Court has held in Various claimants v Barclays Bank plc that an employer was liable for the actions of an independently contracted doctor who carried out the pre-employment medical examinations on its behalf. The High Court needed to assess the question of vicarious liability prior to a full hearing of claims brought by 126 individuals seeking damages against Barclays Bank for alleged historical sexual assaults by the now-deceased doctor.
