TVA IS BEING SUED BY NUCLEAR DEVELOPMENT LLC over its decision to pull the plug on the sale of its Bellefonte plant. The Tennessee Valley Authority had agreed in November 2016 to sell the unfinished nuclear facility, near Hollywood, Ala., to Nuclear Development for $111 million and to close the deal in November 2018 (NN, Dec. 2016, p. 21). According to Nuclear Development's complaint, just days before the November 14 closing date, TVA raised an unexpected issue, claiming that under Section 101 of the Atomic Energy Act, before the sale can be completed, the Nuclear Regulatory Commission must approve the transfer of the construction permits for Bellefon-te-1 and -2, a process that is likely to take months. At that time, Nuclear Development had not filed its application for the permit transfers; the application was submitted to the NRC on November 13. TVA notified Nuclear Development on November 29 that it did not intend to close the sale.
