USA: Google and Association of American Publishers Settle Lawsuit

Google Inc. and five members of the Association of American Publishers (collectively Publishers) on 4 October 2012 reached a settlement to end a Federal lawsuit filed by the Publishers against Google for copyright infringement. The lawsuit alleged that Google infringed the Publishers' copyright by scanning their books from libraries and distributing the digital copies via its search engine as part of its Google's Books Project (Project), which seeks to digitize "more than 130 million books sitting on library shelves." Under the terms of the settlement, which were not fully disclosed, Google (1) may continue to digitize the Publishers' copyrighted books and include them in its index, (2) display up to 20% of the work, and (3) sell the works on Google Play, its online and Android-based marketplace.
