ÉTUDE DU GÉNOME HUMAIN - QUELLES LIMITES À LA LIBERTÉ DE TIRER PROFIT DE SES CARACTÉRISTIQUES BIOLOGIQUES?

The Human Genome Project launched in the United States in 1989 aims at knowing the mapping of our 46 chromosomes. The potential implications of the knowledge of that genetic «horoscope» pose a series of difficult ethical questions, as regards the physician-patient relationship and as regards society. Individuals enjoying a good constitution might seek to draw profits from it. Even if this is already accepted in a number of situations, it should be prohibited in others; for example in respect to basic health care insurance and its premiums. On the other hand, the (hypothetical) discovery of genetic traits linked to socially and/or penally condemned behaviors would force us to reexamine our related basic positions. Some criteria of acceptability for the licit use to one's advantage of genetic data are discussed. It is necessary that ethical thinking be diligently carried out in order to avoid that insufficiently balanced decisions be taken. This demands establishing safeguards, including via legislation.%Le «Human Genome Project» en cours depuis 1989 aux Etats-Unis a pour but de connaître la cartographie génétique de nos 46 chromosomes. Il pose une série de questions éthiques difficiles, au plan de la relation médecin-malade et au plan de la société, quant aux implications possibles de la connaissance de cet «horoscope» génétique. Les personnes jouissant d'une bonne constitution pourront chercher à en tirer profit; or, même si cela est déjà admis dans passablement de situations, cela devrait être prohibé dans d'autres, par exemple dans l'assurance maladie de base. Par ailleurs, la découverte (hypothétique) de traits génétiques liés à des conduites réprouvées socialement et/ou pénalement obligerait à réexaminer certaines de nos positions de principe. Quelques critères d'acceptabilité de l'usage à son propre avantage de ses données génétiques sont discutés. La réflexion éthique sur ces sujets doit être diligemment menée pour éviter que des décisions insuffisamment pesées ne soient prises. Cela implique d'établir des garde-fous, y compris par voie légale.
