Glencore Energy UK Ltd v Cirrus Oil Services Ltd

Early in 2012 negotiations took place between the claimant, Glencore, through Mr Anthony Stimler, and the defendant Cirrus, through Mrs Ivy Owusu, for the sale by Glencore of 630,000 barrels (plus or minus 5 per cent at Glencore's option) of Ebok crude oil at a price of DTD (the index price of Brent crude oil) + US$0.15 per barrel cfr Tema. Mr Edwin Obiri acted as intermediary. The cargo was to be sold on to Tema Oil Refinery (TOR). Following email negotiations, there was a conference call on 3 April 2012 following which Mr Stimler sent the following email, headed "Ebok FIRM offer" to Mr Obiri: "As discussed in an effort to get this wrapped up today as our first crude oil deal with Cirrus, we are willing to offer the following firm (until 6pm this evening) which should now be doable with TOR.
