Directors' and officers' liability: How best to prepare your board for a changing market

The last recognised "hard market" for directors' and officers' (D&O) liability insurance occurred a decade ago, resulting in increased D&O insurance pricing and more stringent terms and conditions. In this document we review the consequences of that hard market, assess the market's current characteristics and offer our perspective on how companies should prepare their boards if conditions change.
