Leeds and London Properties Ltd (the developer) applied to Calderdale MBC (Calderdale) for a development comprising the erection of 21 dwellings (the development) on land off Hollins Road, Walsden, Todmorden (the site), within the urban area of Walsden, within a rural part of the borough. Calderdale's planning officers had recommended that the application should be refused. The planning committee followed this recommendation and the decision notice refusing permission was issued on November 22, 2007. The developer appealed to the Secretary of State.
