The Council originally refused the planning application as it did not consider it to be a suitable proposal. The applicant exercised his right of appeal. In my view, the Council then had a duty to defend its decision and respond to the Planning Inspectorate. The Council did not robustly defend the appeal. It did the minimum required by returning the appeal questionnaire. It had the opportunity to suggest conditions but did not do so.
