Outline planning permission for residential development of land at Merton Green was granted in June 2006, replaced by an identical grant of permission in June 2007. In March 2007, Monmouthshire CC ("the Council") appropriated the land for planning purposes. In October 2007, the claimant purchased the land from the Council and in March 2010 actual development of the land commenced. On July 24, 2009, the Merton Green Action Group made an application under s.15 of the Commons Act 2006 ("the 2006 Act") to register the land as village green.
