The Claimants applied to quash the Forest Heath Core Strategy ("FHCS") which was adopted by the Forest Heath DC ("the Council") on May 12, 2010. The policies in the FHCS under attack related to an urban extension to the north-east of Newmarket for approximately 1,200 dwellings as part of a mixed use development which was intended to take place over 20 years. The Claimants' main concern was that the development would have a seriously adverse effect on the horse racing industry for which Newmarket was recognised as the capital of the horse racing industry in national and international terms.
