The Interpretation of Planning Policy after Tesco

In this article we explore the origin and implications of the judgment of the Supreme Court in Tesco Stores Ltd v Dundee CC. The judgment marks a definitive change to the way in which planning policies can be lawfully interpreted. Until Tesco, the predominant approach taken by the court to the interpretation of planning policy was one which asked the question whether or not the decision maker was adopting a reasonable meaning of the policy.
