Government Consults on Changes to Waste Regulations 2011 on Co-mingling Recyclable Waste

On February 23, 2012, Defra launched a consultation on amending reg.13 of the Waste (England and Wales) Regulations 2011 ("Waste Regulations").'Regulation 13 currently provides that co-mingled collection of recyclables is a valid form of separate collection of recycling. The consultation closes on April 12, 2012. The proposed amendment will require organisations collecting waste to collect paper, glass, metal and plastic by means of separate collection from January 1, 2015. However, waste collection authorities will retain some discretion, as the proposed amendment provides that separate collection will not be required if it is not practicable or necessary.
