The conclusion reached by this court was consistent with other case law. Unfortunately for plaintiffs this holding does not leave many options for relief in the future. This case does serve to aid future plaintiffs, but these cases walk the fine line between non-justiciability and mootness. It therefore seems unlikely that plaintiffs in the future will have much luck in winning an action against an agency with delegated powers like the BLM. A major issue appears to be the fact that individual BLM offices retain a great deal of control over what happens in their HMAs.
