Executive Order Encourages Project Labor Agreements on Federal Projects

On February 6, 2009, President Barack Obama issued Executive Order 13502 (Obama order), effective for contract solicitations commencing 120 days from the date of issuance, which encourages federal agencies to consider, on a case by case basis, requiring project labor agreements (PLAs) on construction where the total cost to the federal government exceeds $25 million. Prior to this order, federal agencies were prohibited from requiring PLAs on federal construction in cases where using a PLA will "advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters," and be otherwise consistent with applicable law.
