Classification and Analysis of Notice Requirements for Construction Contract Administration

Requirements involving notices are widely spread throughout the conditions of every project's construction contract. Project participants very often encounter a variety of events and occurrences that necessitate the issuance of notices, where the possible mishandling of their related requirements by contract administrators may expose the concerned party of the construction contract to major risks. The objective of this paper is to shed light on the critical importance of the wide range of notice provisions encountered in construction contracts. As such, the paper reports on the methodological construction of a classification matrix of the notice requirements stipulated under a selected set of standard contract conditions. Detailed statistics and analyses are presented, which propose expanding the perspectives of contract administration professionals regarding notices and their administration. Critical findings include the observed dominance of notices over a wide spectrum of contract conditions, with a range of numerical and qualitative time-barring requirements. Both contract parties are found to carry a balanced responsibility distribution toward the administration of encountered notices.
