DOT Chief Administrative Law Judge Dismisses $1 Million Civil Penalty Case For Failure To Meet Two-Year Regulatory Limitations Period
On October 10, 2002, Department of Transportation Chief Administrative Law Judge Ronnie A. Yoder dismissed a $1 million hazardous materials civil penalty case brought by the Federal Aviation Administration ("FAA") because the FAA failed to meet its two-year regulatory limitations period (hereinafter "Decision"). Although the FAA generally initiates its enforcement cases in a timely manner, this decision reinforces the importance of making sure that the FAA has complied with this two-year limitation period in hazardous materials cases that it prosecutes.
