Mergers and acquisition transactions are a business reality. In 2017 there were 51,882 mergers and acqui-ÊL sitions, while 45,000 are projected for 2018. Complying with government regulations is another business certainty. Therefore, parties of a merger or acquisition transaction must naturally face the issue of ensuring continued compliance with applicable regulations. Entities that do not regularly handle hazardous materials and even hazmat companies that are parties to a merger or acquisition may not be aware of their respective obligations, liability, and costs resulting from compliance with federal requirements under the Hazardous Materials Regulations, Title 49 C.F.R. Parts 100 - 185 (HMR). For instance, one such compliance obligation is the HMR's record retention requirements.
