Basically, Smart Hose asked if the amendments to the sections as referenced herein in the light of the technology presented to PHMSA were sufficient in themselves to allow for their equipment to be used without the need of a Special Permit. PHMSA did agree that the technology is covered by the amended HMR and instructed the petitioner that inspection requirements must be met and that these sections do not relieve or otherwise affect the requirements of §176.76 (i) for CTUs with Division 2.1 or Class 3 materials with flashpoints ＜ 23°C on deck. Further they were instructed that §177.840(p) instructs on requirements for liquid petroleum gas and anhydrous ammonia in metered service and does not include references to the hoses allowable in the subject of this LOI and referenced SPs.
