Telefonica and Portugal Telecom v Commission: Assessment of a Non- Compete Clause Unrelated to the Actual Transaction

The General Court ruled that the European Commission rightfully qualified a non-compete clause as an object restriction in spite of the fact that the contract provided that the stipulation was valid only 'to the extent permitted by law'.
