Mercury regulation (or lack thereof) under CEPA provides an example of how the Act has functioned to date. Past government efforts to address the most significant Canadian emissions of mercury have relied on non-binding pollution prevention planning and Canada Wide Standards, which have resulted in relatively slow progress in eliminating the dangers caused by mercury. The tide may, however, be turning with the announcement of new government initiatives, including the federal government's Intent to Regulate Air Pollutants and the Risk Management Strategy for Mercury-containing Products. However, the nature and extent of mercury emission reductions that these future regulatory instruments may contain remain uncertain.
