LEGAL ASPECTS OF MARINE POLLUTION

The study is partly historical and analytic and partly a critique of the ideas and events that are affecting a profound transformation in the international law of the sea. The importance of the world's oceans cannot be over estimated. Life began in the oceans and it remains our link to life through its control of climate, provision of food and minerals. It must be emphasized, however, that this article is concerned solely with canvassing this question of legal aspects of marine pollution in the light of existing international law. The importance of the problem, with its public impact on traditional legal concepts, has attracted the attention of writers and of several bodies interested in the development of international law. It is to be noted out of the present ferment will reconcile new needs with established patterns in such a manner as to win general assent. To this end it may be useful, now that there are some years of state practice and learned discussion to draw upon, to correct on varioes views that have been advanced. For the purposes of framing the whole legal system, obligation, responsibility and customary laws are being undertaken.
