The appellant had been convicted of sexual assault, contrary to s. 3 of the Sexual Offences Act 2003. He had been drinking heavily, and, at his request, was taken to hospital by the police. He caused a disturbance at the hospital and the police took him outside. He danced suggestively in front of one of the police officers and became angry when he was discouraged from going back into the hospital. He punched the officer in the stomach. He then took his penis out of his trousers and rubbed it up and down the officer's thigh. He was arrested.
