Causing Another to Fear Violence-Requirement under s. 4 of the Protection from Harassment Act 1997 to Show a Course of Conduct

The appellant (H) was convicted on 25 May 2010 at Snaresbrook Crown Court of an offence contrary to s. 4(1) of the Protection from Harassment Act 1997. The statement of the offence on the indictment that he stood trial on read 'putting a person in fear of violence by harassment . . .', whereas s. 4 is headed 'putting people in fear of violence'. The particulars of the offence on the indictment mirrored the precise language of s. 4(1) and stated that between 3 and 12 January 2009 H had caused Mohammed Nazrul Islam, the complainant (C), 'to fear that violence would be used against him by his course of conduct which he knew or ought to have known would cause fear of violence to Mohammed Nazrul Islam on each . . . occasion' in that between these dates he had sent threatening e-mails and letters.
