ENVIRONMENTAL RIGHTS IN NIGERIA AND INDIA

The Nigerian Constitution does not contain a provision similar to Article SIA of the Indian Constitution which gave private person the right to institute legal action in order to protect and preserve the environment. Despite this, the Indian judicial decisions constitute persuasive precedents for Nigerian courts.
