Insolvency rules could be suspended amid virus crisis

Authorities around Europe may suspend one of the fundamental principles of insolvency law in order to allow distressed businesses to accept emergency loans to keep them operating during the coronavirus crisis. Jurisdictions have long forbidden directors of companies from taking on extra debt if they know they are already insolvent. Instead, boards must file for insolvency, rather than trade wrongfully.
