EU Commission Takes Italy, Spain to Task Over Landfills, Construction, Waste Dump

The European Commission March 19 warned Italy that it could face fines if it does not comply with a European Court of Justice (ECJ) ruling that it improperly transposed EU legislation on landfills.rnThe ECJ ruled in April 2008 that Italy's transposition of the 1999 EU Directive on the landfilling of waste (1999/31/EC) did not conform with EU law, especially regarding definitions and permit procedures for landfill sites (Case No. C-442/06, Commission of the European Communities v. Italian Republic, 2008 E.C.J.).rnUnder EU law, in the case of noncompliance with a judgment, the Commission may return to the ECJ and ask for fines to be levied if two further written warnings do not lead to a satisfactory response.
