Energy Communities-a New Market Actor in the Electricity Sector Under the Clean Energy Package

The Electricity Directive and the Renewables Directive create opportunities for the emergence of energy communities in Member States where these entities do not currently exist and grant additional rights/incentives to existing initiatives. At the same time, the Directives do not seek to limit those Member States that want to pursue consumer activation in different forms. It is also important to note that, under art. 16 para.4(c), the Directives safeguard the legitimate interests of other energy-market actors and seek to protect the public interest. This means that there is no longer any incentive to use energy communities as arrangements for avoiding the imposition of specific duties.
