Universities may not get the full benefit of work undertaken by their academic staff and researchers following a recent decision of Australia's High Court. The case suggests that, in the absence of express agreement that includes a duty to invent, an academic or research based employee of a university may own the IP in inventions they create whilst employed by the university, even if the creation of those inventions is funded by the university.
