On 5 February 2014, the Regional Court of Duesseldorf handed down an interesting decision in the long-debated matter of admissibility of trademark infringement in the field of scale-model toy cars. The battle between car manufacturers and the toy car industry was taken over, in this particular case, by the Italian luxury sports car producer Ferrari on one side, and the German retail and distribution chain, KiK, on the other. Ferrari had become aware that KiK had sold on a national scale, through its wide network of resellers in Germany, low-cost model toys of red Formula 1 cars reproducing a trademark bearing the sign of a black lion inside a yellow shield.
