The Minnesota Department of Labor and Industry has issued guidance for employers on the state’s new “WageTheft Law” that goes into effect on July 1, with the except of criminal wage theft and sanctions that will go intoeffect on August 1.On May 30, Minnesota Governor Tim Walz signed into law a budget bill-Ch. 7 (H. 2), L. 2019-that, in additionto providing a budget and policy changes for jobs, economic development, energy, and commerce, andeconomic development programs, also establishes “wage theft” prevention measures.Changes to various laws affecting wage payment requirements, mainly under Chapters 177 and 181, the state’sFair Labor Standards Act and wage payment law, include adding new, higher penalties for repeat violations,adding new notice and recordkeeping requirements, amending contractor requirements, adding protections foremployees from retaliation by employers for filing complaints, and amending enforcement provisions, includingauthorizing the attorney general to enforce provisions relating to wages and labor standards.
