The New York Department of Labor has decided to withdraw proposed regulations on employee scheduling,according to updated information on the Department’s Internet website. The Department had proposed theregulations following a series of public hearings in 2017.The proposed regulations addressed “call-in” or “on-call” scheduling, also known as “just-in-time” scheduling.Based on extensive feedback, the Department determined that its proposed regulations were seen as a “onesize-fits-all” approach that was not appropriate for every industry. Comments on revised rules that were issuedin 2018 indicated that serious issues remained, and the revisions did not achieve the balance of certainty andflexibility for workers or for businesses. Due to constraints in the regulatory process, the Department determinedthe best course of action was to allow the proposed regulations to expire and to reevaluate in the future, likelyworking with the state Legislature
