On March 14 and 15 the National Labor Relations Board released several advice memos dealing with topicsthat ranged from employer handbook rules to the union’s duty of fair representation, discriminatory contract nonrenewal,and Facebook postings about safety concerns. Most of the memoranda are from mid-2018 to early2019, although one dates back to 2015.Duty of fair representation. In Local 1199 SEIU (South Oaks Hospital-Northwell Health) (29-CB-215856),a February 25, 2019, advice memo addresses the question of whether a union breached its duty of fairrepresentation by willfully misleading employees about their future terms and conditions of employment andwaiving their contractual rights to grieve an involuntary transfer and to receive severance pay.
