The law of trade-marks and unfair competition, including passing off, is dealt with in Canada both by federal statutory provisions and by provincial common law. Unlike patents or copyright, there is no specific constitutional allocation as between provincial and federal jurisdiction concerning trade-marks and unfair competition and both aspects, federal and provincial, should be considered with respect to any question relating to trade-marks and unfair competition, even though considerable overlap exists.
