Caution Advised in Commitment of Project-Based Funds Because of Need for Environmental Reviews

PHAs should be careful to issue only a conditional commitment of Section 8 project-based voucher (PBV) funds until a Phase I environmental site assessment is conducted and, where required, a full environmental review is completed, said Christopher A. Thompson of Powell Goldstein LLP, who spoke at the American Bar Association's recent affordable housing forum. The key issue is timing, said Thompson, since a full environmental review must be completed and approved by HUD before the commitment of federal funds. However, he also noted that some HUD multifamily projects are categorically exempt from an environmental review.
